General Terms and Conditions of Sale

Article 1. General

1.1 These General Terms and Conditions apply to all agreements relating to online orders between UPPAbaby.nu and the customer.

1.2 UPPAbaby.nu reserves the right to amend these General Terms and Conditions and the content of its website at any time.

1.3 By placing an order, the customer unconditionally agrees to these General Terms and Conditions.

Article 2. Prices and Offers

2.1 All prices listed on the website are in euros (€) and include VAT, unless stated otherwise. Shipping costs are not included in the listed prices.

2.2 UPPAbaby.nu shall not be liable for any typographical, printing, programming, or other errors on its website. No rights may be derived from incorrect pricing information.

2.3 Offers are valid while stocks last and only for the period specified.

Article 3. Payment

Payment must be made using one of the payment methods offered on the website. Available payment methods include:

  • iDEAL
  • Credit Card
  • PayPal
  • Bancontact
  • Apple Pay

If the customer fails to make any payment when due, UPPAbaby.nu reserves the right to suspend or terminate the relevant agreement and any related agreements.

Article 4. Shipping Costs

4.1 Shipping costs are as follows:

  • The Netherlands: €7.95 for orders under €50.00. Orders of €50.00 or more qualify for free home delivery
  • Belgium: €7.95 for orders under €100.00. Orders of €100.00 or more qualify for free home delivery
  • Luxembourg: €10.00 for orders under €100.00. Orders of €100.00 or more qualify for free home delivery

4.2 The customer is responsible for the shipping costs of returning items.

Article 5. Delivery

5.1 UPPAbaby.nu uses PostNL, DHL, and DPD for the delivery of orders.

5.2 UPPAbaby.nu aims to dispatch orders within one week.

5.3 UPPAbaby.nu will make every reasonable effort to deliver accepted orders as quickly as possible. If delivery is delayed due to temporary stock shortages or any other reason, or if an order cannot be fulfilled in whole or in part, the customer will be informed accordingly. In such cases, the customer has the right to cancel the outstanding part of the order either verbally or in writing.

5.4 The statutory maximum delivery period is 30 days. If the customer has not received the order within this period, they are entitled to cancel the purchase free of charge.

5.5 UPPAbaby.nu shall not be liable for any damage resulting from delivery to an incorrect address provided by the customer.

Article 6. Order Cancellation

6.1 Orders may be cancelled within 24 hours after being placed, provided they have not yet been shipped. Cancellation requests must be submitted by email.

Article 7. Returns and Exchanges

7.1 Upon receipt and acceptance of a returned product, UPPAbaby.nu will refund the full purchase price. Return shipping costs and the risk of return shipment remain the responsibility of the customer.

7.2 The following conditions apply to returns:

1. You have 14 days from the date of delivery to exchange or return your items. After this period, the purchase agreement can no longer be cancelled.
2. Requests for exchanges or returns must be submitted to UPPAbaby.nu in writing before returning the products.
3. Returned products must be unused, unworn, and in their original packaging.
4. Returns sent without sufficient postage will not be accepted, regardless of the reason for the return.

7.3 Refunds for returned products will be processed within 30 days after receipt of the returned items, or sooner where possible.

Article 8. Stock Availability

8.1 Most products are available from stock. However, products may occasionally be temporarily unavailable or sold out. The customer will be informed as soon as possible. In such cases, the customer may cancel the order free of charge, and UPPAbaby.nu will issue a full refund.

Article 9. Warranty and Liability

9.1 UPPAbaby.nu warrants that the products supplied meet the normal standards of quality and usability and are free from defects.

9.2 Proof of purchase issued by UPPAbaby.nu serves as proof of warranty.

9.3 If a delivered product does not comply with this warranty, UPPAbaby.nu will, at its sole discretion, repair or replace the product within a reasonable period after receiving it, or, where return is not reasonably possible, after receiving written notification of the defect. In the event of replacement, the customer agrees to return the replaced product to UPPAbaby.nu and transfer ownership of that product to UPPAbaby.nu.

9.4 This warranty does not apply if the defect results from improper or inappropriate use, or if the customer or a third party has modified or attempted to modify the product without the prior written consent of UPPAbaby.nu, or has used the product for purposes other than those for which it was intended.

9.5 If the delivered product does not conform to the agreement and such non-conformity constitutes a defect within the meaning of applicable product liability legislation, UPPAbaby.nu shall not be liable for any consequential damages arising therefrom.

9.6 Nothing in these Terms and Conditions affects the customer's statutory warranty rights, subject to the provisions of these Terms and Conditions and the relevant agreement, including the nature and characteristics of the products supplied.

9.7 Where the manufacturer of a defective product is liable for consequential damages, the liability of UPPAbaby.nu shall be limited to repair or replacement of the product or reimbursement of the purchase price.

9.8 Without prejudice to the foregoing, UPPAbaby.nu shall not be liable where the damage results from intentional misconduct, gross negligence, or improper or inappropriate use by the customer.

9.9 The limitations of liability contained in these Terms and Conditions shall not apply where damage is caused by the intentional misconduct or gross negligence of UPPAbaby.nu or its employees.

Article 10. Privacy Policy

10.1 UPPAbaby.nu respects the privacy of all users of its website and ensures that personal information provided by customers is treated confidentially. Personal data is used solely to process orders efficiently. UPPAbaby.nu will never sell personal data to third parties and will only share such data with third parties involved in processing and delivering orders. Employees and third parties engaged by UPPAbaby.nu are required to maintain the confidentiality of customer information.

10.2 UPPAbaby.nu uses customer information for the following purposes:

1. To process and deliver orders, we require your name, email address, delivery address, and payment details.
2. Your email address may also be used to inform you about website developments, promotions, and special offers. By accepting these Terms and Conditions, you consent to receiving such communications. You may unsubscribe at any time.

Should changes to this Privacy Policy become necessary, the most recent version will always be available on this page.

Article 11. Copyright

11.1 It is prohibited to copy, store, publish, reproduce, or otherwise use any text or images from this website without prior written permission from UPPAbaby.nu. Legal action may be taken in the event of infringement.

Article 12. Complaints, Questions and Comments
